Any and all rights to use any of the Materials that are not expressly granted under these Terms are reserved to Americanos Magazine. You acknowledge and agree that you will not, directly or indirectly, aid or assist in contesting or challenging the validity or ownership of the Materials, or take any action in derogation of Americanos Magazine’s rights therein. You acknowledge and agree that you will not acquire or claim any rights in the Materials, or assist or abet any other person in doing so.

Your license to use MATERIALS available on our Sites

You may visit our Sites without further permission from Americanos Magazine Inc. and Americanos Magazine grants you a non-exclusive, non-commercial, revocable, non-transferable, limited, personal license to use, download, view and reproduce the Materials. This license is subject to your full compliance with these Terms. Americanos Magazine encourages you to report any content on the Sites that you believe infringes your rights. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), Americanos Magazine has a designated agent to receive notifications of copyright infringement and Americanos Magazine follows the detection and takedown procedures of the DMCA. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Americanos Magazine’s copyright agent with the following information required by the Copyright Infringement Online Warranty Limitations Act of the DMCA, 17 USC 512: (A) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (B) identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works at that site; (C) identification of the material that is claimed to be infringing or to be the subject of infringing activity and information reasonably sufficient to permit us to locate the material; (D) information reasonably sufficient to permit us to contact the complaining party; (E) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (F) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

We have a policy of removing users who (in our reasonable judgment) are repeat infringers.

We may request additional information before removing any infringing material. If a dispute develops as to the correct owner of the rights in question, we reserve the right to remove your content along with that of the alleged infringer until resolution of the issue.

You understand that User Content shall not be maintained on the Site by us for any period of time and we reserve the right to remove it at any time. All of your User Content is your sole responsibility. This means that you, and not Americanos Magazine, are entirely responsible for all User Content that you submit, post, email, transmit or otherwise make available through our sites.
